The Complex Challenges of Legal Translation

The challenges that legal translators address are specific to their tasks as translators of law.

Legal translation is a complex minefield that requires specialist translators who are experts, not only in translation, but also in legal terminology.

This means they must be fluent in the language they are translating from, the language they are translating to, and also have an in-depth knowledge of the legal systems of both countries.

As with all legal documents it is expected that there should be a high level of accuracy, but also translators must be conscious of tone of voice, register, terminology and ambiguity.

Inaccuracies can delay court hearings, invalidate documents and damage business connections, costing money and time to those involved.
Some of the challenges specific to legal translation are outlined below:

Two legal systems

When translating a legal document it is converted from one language and one set of laws, to another language and a different set of laws.

The problems arise when there are complex laws that exist in one country that have no relevance or equivalent in the other. For example, ‘Equity’ has no counterpart in continental law and most of its rules are unique with no parallels within other systems.

Specialist legal translators will have expert knowledge of both legal systems, ensuring the relevance of a translated document.
Legal jargon

We all know that in everyday speak we would use one word to describe something, whereas in legal documents you would use ten.

Legal documents are notoriously difficult to comprehend due to the particulars of law and the complexity with which they are written.  English law, for instance, is full of complex compound sentence structures and a multitude of subjects, alongside specialist legal terminology.

Understanding legal vocabulary, in at least two languages, and translating documents with accuracy between these languages, is a skill that takes years to perfect. Translators who are adept at this can charge high rates for their expert knowledge.

Tone of voice

The English legal system is renowned for its highly formal tone and the use of a passive voice. Other countries often use a more active voice. The difference between the two causes the need for a highly skilled translator, who can accurately portray the correct tone of voice from an English document, into a foreign language with an active voice.

If a translation is done correctly there will be no inconsistencies, or inaccuracies, and it will be precise in its tone and register.

There is little room for error in the translation of a legal document, so it is always advisable to enlist the skills of a specialist legal translator to avoid wasting time and money. They are highly accomplished linguists with extensive knowledge of legal terminology and legal systems in a variety of countries.

Their ability to translate with precision and clarity will ensure you receive the best translation for your money.
